The Delhi Police is all set for the three new criminal laws that will come into force across the country in a few hours.

Starting Monday, the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) will replace the Criminal Procedure Code (CrPC); the Bharatiya Nyaya Sanhita (BNS) will replace the Indian Penal Code; and the Bharatiya Sakshya Adhiniyam will replace the Indian Evidence Act.

To help police personnel audio-video record search and seizure operations in a case, in line with the BSA, the police launched a new app called E-Praman. Starting July 1, dedicated help desks will be set up in all districts for police personnel to report any queries and technical issues on the app, said Delhi Police Commissioner Sanjay Arora.

In an order issued on June 29, Police Commissioner Arora said as per the new laws, search and seizure of case records has to be video and audio recorded. For this purpose, the E-Praman application of the Delhi Police has been developed to help investigating officers (IO), PCR officers, traffic personnel, and other field officers.

The Commissioner said, “If there is any technical issue pertaining to the usage of the application for some or the other reason, then the officer can use any phone or video recording device present at the time to capture the search and seizure process… However, this can be used only during a contingency.”

Festive offer

The Commissioner added that using such phones, which can be of any other person, in case of a contingency should be recorded as a DD (daily entry) entry, and the reasons for doing so should be recorded too, to ensure laws are followed.

Meanwhile, all Delhi Jail superintendents were asked by senior prison authorities to provide and keep adequate computers and other hardware units ready to prepare a pilot programme for video production of all inmates, which is now mandated under the new laws.
